BindiMart Terms of Service
Effective Date: 1st June,2026.
Welcome to BindiMart (“BindiMart”, “Platform”, “we”, “us”, or “our”). BindiMart is an online marketplace that enables customers (“Customers”, “Buyers”, “you”) to discover, select, and purchase handmade and handcrafted products offered by independent artists, artisans, creators, and sellers (“Artists”, “Sellers”).
By accessing or using the BindiMart website, application, or services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use the Platform.
1. About BindiMart
BindiMart operates as a digital marketplace connecting Artists with Customers interested in handmade products, including but not limited to textiles, handicrafts, artwork, home décor, accessories, traditional crafts, and other creative products.
BindiMart provides the technology platform, marketplace access, customer experience support, payment facilitation, and coordination services. Unless specifically stated otherwise, products listed on BindiMart are created, owned, supplied, and fulfilled by independent Artists/Sellers.
BindiMart does not manufacture all products listed on the Platform.
2. Artist-Seller Responsibility
Artists listing products on BindiMart agree that they are responsible for:
Providing accurate product descriptions, images, dimensions, materials, pricing, and availability information.
Ensuring that products are handmade, handcrafted, original, or appropriately represented.
Maintaining quality standards and authenticity of their products.
Packaging products safely and appropriately.
Dispatching products within the timelines communicated to Customers.
Complying with applicable laws, including intellectual property, taxation, and consumer protection requirements.
Ensuring that products do not infringe third-party rights.
Artists acknowledge that handmade products may naturally contain variations in colour, texture, finish, patterns, and minor imperfections due to the nature of craftsmanship. Such variations shall not be considered defects.
3. Customer Responsibilities
Customers agree to:
Provide correct delivery information, contact details, and payment information.
Review product descriptions, dimensions, images, materials, and delivery timelines before placing an order.
Use products responsibly and according to their intended purpose.
Not misuse the Platform, create fraudulent orders, or engage in unlawful activities.
Customers understand that handmade products may differ slightly from photographs due to handcrafted production processes and screen/display differences.
4. Orders and Payments
An order is considered confirmed only after successful payment and order confirmation from BindiMart.
BindiMart reserves the right to cancel or refuse orders in cases including:
Incorrect pricing due to technical errors.
Product unavailability.
Suspected fraudulent activity.
Violation of these Terms.
Payments may be processed through third-party payment gateways. BindiMart does not store complete payment card details.
5. Shipping and Delivery
Products are shipped according to timelines provided by the Artist/Seller.
Delivery timelines may vary depending on:
Product type.
Handmade production requirements.
Artist location.
Courier availability.
Customer location.
Unforeseen circumstances.
BindiMart and Artists will make reasonable efforts to ensure timely delivery but do not guarantee delivery dates unless explicitly confirmed.
6. No Refund Policy
BindiMart follows a No Refund Policy.
Once an order is placed and accepted, Customers cannot request cancellation, return, or refund for reasons including:
Change of mind.
Personal preference changes.
Colour expectations differing slightly due to screen settings.
Minor variations inherent to handmade products.
Product size or design expectations where specifications were clearly provided.
7. Replacement Policy
7.1 Textile Products
For textile products only, BindiMart provides a one-time replacement opportunity in cases where:
The product received is damaged.
The wrong product is delivered.
The product has a manufacturing defect.
Customers must notify BindiMart within 12 hours of delivery with:
Clear photographs/videos of the product.
Order details.
Description of the issue.
Approval of replacement requests will be subject to verification.
The replacement will be provided only once per order and is subject to product availability.
No refund, cash compensation, or repeated replacements will be provided.
8. Damaged, Incorrect, or Defective Products
If a product arrives damaged, incorrect, or materially different from the listing:
The Customer must report the issue within 12 hours of delivery.
BindiMart may coordinate with the Artist/Seller to review the claim.
Resolution may include replacement, repair (where possible), or another appropriate solution.
BindiMart reserves the right to determine whether an issue qualifies as a defect or acceptable handmade variation.
9. Platform Liability
BindiMart acts as a marketplace facilitator connecting Customers and Artists.
BindiMart shall not be responsible for:
Manufacturing defects caused by Artists.
Product quality issues arising from Artist workmanship.
Incorrect product information provided by Artists.
Delays caused by Artists, logistics partners, or external circumstances.
Product misuse by Customers.
Natural variations in handmade products.
BindiMart will make reasonable efforts to maintain a reliable marketplace experience but does not provide any guarantee regarding every product listed by independent Artists.
10. Artist Liability
Artists/Sellers are solely responsible for:
Product authenticity.
Product quality.
Product safety.
Accuracy of listings.
Legal ownership of designs, artwork, and products.
Compliance with applicable laws.
Artists agree to indemnify and protect BindiMart against claims, losses, damages, penalties, or disputes arising from their products, listings, or actions.
11. Customer Liability
Customers are responsible for:
Providing accurate order information.
Proper use and care of purchased products.
Not making fraudulent claims.
Not misrepresenting product issues.
Customers agree not to misuse replacement policies or create false complaints.
12. Intellectual Property Rights
All content on BindiMart, including logos, website design, text, graphics, and platform features, belongs to BindiMart or its licensors.
Artists retain ownership of their original creative works unless otherwise agreed.
Artists grant BindiMart permission to display product images, descriptions, and related content for marketplace promotion and sales purposes.
No user may copy, reproduce, distribute, or commercially exploit content without permission.
13. Account Suspension and Termination
BindiMart may suspend or terminate access to users or Artists who:
Violate these Terms.
Provide false information.
Engage in fraudulent activities.
Harm the reputation or operation of the Platform.
14. Privacy
Customer and Artist information will be handled according to BindiMart’s Privacy Policy.
By using the Platform, you consent to the collection and use of information required to provide marketplace services.
15. Limitation of Liability
To the maximum extent permitted by law, BindiMart shall not be liable for indirect, incidental, special, or consequential losses arising from:
Use of the Platform.
Purchase of products.
Artist actions.
Delivery delays.
Product-related disputes.
BindiMart’s maximum liability, if any, shall be limited to the amount paid by the Customer for the specific transaction giving rise to the claim.
16. Force Majeure
BindiMart shall not be responsible for failure or delay caused by circumstances beyond reasonable control, including natural disasters, government restrictions, strikes, courier disruptions, technical failures, or other unforeseen events.
17. Governing Law
These Terms shall be governed by the laws of India.
Any disputes shall be subject to the jurisdiction of courts located in Ahmedabad, Gujarat, India.
18. Changes to Terms
BindiMart reserves the right to update these Terms from time to time.
Continued use of the Platform after updates constitutes acceptance of the revised Terms.
